FLT offers MSACCO Service to the Customer on the terms herein. These terms form the contract between FLT and the Customer, and are in addition to — not in derogation of — other terms relating to any Account or Service.
To access MSACCO Service, the Customer must register at their sponsor institution or apply online via their mobile phone or electronic device.
Transacting under MSACCO Service requires transaction data verification. The Customer must strictly adhere to privacy procedures to ensure safe keeping of login credentials.
By accepting these terms on your mobile phone during registration, the Customer:
Agrees to use MSACCO Service for financial transactions offered by FLT from time to time.
Irrevocably authorizes FLT to debit enabled Accounts for all transactions undertaken using Customer Identification Data.
Authorizes FLT to map the account number, User ID, and Mobile Phone Number for the smooth operation of MSACCO Service, and to use such data to provide or enhance further products.
Agrees that transactions originated using mobile phones are non-retractable, as these are instantaneous/real-time.
Accepts that the Customer is solely responsible for maintaining the secrecy and confidentiality of Customer Identification Data without any liability to FLT.
MSACCO services are regulated by the Bank of Uganda under the National Payment Systems Act, 2020 and the NPS Regulations 2021.
MSACCO services are subject to the Anti-Money Laundering Act 2013 (as amended in 2017 and 2022). The Customer agrees that FLT has a transaction monitoring framework and shall submit suspicious transaction records to the Financial Intelligence Authority.
It is the Customer's responsibility to provide correct information to FLT through use of MSACCO Service. FLT will endeavor to correct errors on a best-effort basis if reported promptly.
In case of any discrepancy, FLT shall not be responsible for errors occurring despite steps taken to ensure accuracy, and the Customer shall have no claim against FLT for loss or damage resulting therefrom.
FLT reserves the right to charge the Customer a fee for services provided under MSACCO and to change the fee structure at its discretion.
Fees may be collected in such manner and at such intervals as FLT may specify.
Charges are exclusive of amounts payable to the Telephone Service Provider and will be debited from the Customer's account instantly.
The Customer shall act in good faith and exercise reasonable care to keep Customer Identification Data confidential. At no time shall the Customer disclose such data to any third party.
The Customer confirms that all persons whose data is transmitted or processed have consented thereto in accordance with extant laws.
The Customer is responsible for all transactions — including fraudulent or erroneous transactions — made through their mobile phone, SIM card, and Customer Identification Data, regardless of whether such transactions were authorized by them.
The Customer must notify FLT immediately upon suspecting misuse of their Customer Identification Data and must initiate steps to change it immediately.
The Customer is solely responsible for legal compliance relating to their mobile connection, SIM card, and mobile phone through which MSACCO Service is availed.
The Customer shall keep updated with any modifications to MSACCO services published on the Website.
The grant of MSACCO Service to a Customer is not transferable under any circumstance and shall be used only by the Customer. However, FLT shall have the right to transfer, assign, or sell all its rights under these terms, which shall remain in force for the benefit of FLT's successors and assigns.
The customer permits FLT to obtain from their sponsor institution any information relevant to the effective utilization of MSACCO Service.
The customer permits FLT and sponsor institution to transfer information relating to the customer between their representatives, auditors, and agents for confidential use on a need-to-know basis.
For credit scoring and credit appraisal purposes, the Customer consents to FLT disclosing information to a financial institution, SACCO, MFI, or Credit Reference Bureau with whom FLT has a contractual confidentiality agreement.
The Customer consents to FLT and sponsor institution accessing their CRB reports for creditworthiness evaluation purposes.
Without prejudice to anything contained in these terms, FLT, third-party service providers, and their respective licensors and partners make no express or implied warranty regarding the use or results of MSACCO Service — including any warranties of non-infringement, title, marketability, accuracy, reliability, suitability, satisfactory quality, or fitness for a particular purpose.
Without prejudice to any other provisions herein, FLT shall not be liable to the Customer for any loss or damage whatsoever, arising directly or indirectly in connection with MSACCO Service and/or these terms. FLT expressly excludes liability for consequential loss or damage, or any loss of profit, business, revenue, goodwill, or anticipated savings arising in respect of MSACCO Service.
In consideration of FLT providing MSACCO Service, the Customer agrees to indemnify and keep FLT harmless from and against all actions, claims, demands, proceedings, loss, damages, costs, charges, and expenses that FLT may incur as a consequence of acting in good faith. The Customer shall indemnify FLT for unauthorized third-party access to any information or instructions given by the Customer, or for any breach of confidentiality.
FLT or its employees/contractual staff will not be liable for:
- Any unauthorized use of the Customer's Identification Data attributable to the Customer.
- Unauthorized access to the Customer's mobile phone number, instrument, or email address for fraudulent, duplicate, or erroneous instructions.
- Acting in good faith on instructions received from the Customer.
- Error, default, delay, or inability to act on instructions.
- Loss of any information, instructions, or alerts in transmission.
- Unauthorized access by any other person to the Customer's information or instructions.
FLT reserves the right to limit the amount and frequency of payments made using MSACCO Service, with 30 days' prior notice to the Customer.
FLT shall not be liable for any loss or damage incurred due to the negligence, act, or omission of any third party.
The Customer is solely responsible for the selection of their device and Telephone Service Provider, and for all issues or disputes between the Customer and such providers.
MSACCO Service may be discontinued by FLT at any time upon giving the Customer at least 14 days' prior written notice. If the Customer is involved in criminality, the 14-day notice shall not apply.
FLT reserves the right to introduce additional services with or without notice. The Customer authorizes FLT to send SMS regarding its products and services, with the option to opt out at any time.
The Customer consents to pay for services through their respective sponsor institution in accordance with Schedule A attached.
FLT reserves the right to change prices in Schedule A and shall publish such changes in a revised Terms & Conditions document 30 days ahead of the effective date.
